The Utah Republican Party, State Officers, and State Central Committee Members are failing their duty owed to their members. According to the Utah Republican Party Constitution, Article XII. Section 2. State Nominating Conventions, a candidate for an office that receives 60% or more of the votes cast at any point in the balloting process at the state nominating conventions shall proceed to the general election. "
On April 27, 2024, the Utah Republican Party held its nominating convention, the indirect primary, where state delegates elected the party nominee, Phil Lyman, for the office of Utah Governor. Pursuant to Utah Code 20A-9-407(6), State Party Chair, Robert Axson, was to certify the names of the candidates nominated at the convention for the general election ballot. The Lieutenant Governor, Deidre Henderson, who is also sought the office of the lieutenant governor as a joint-ticket with Spencer Cox and controls the ballot, forced Phil Lyman along with his joint-ticket pick for lieutenant governor to a direct primary violating the internal procedures of the political party, a huge violation of the party members right.
Although we are confident that, Phil Lyman, who is seeking judicial remedy, will be successful, this mock-up of being a member of this phony political party is nothing but a facade. As members we have been harmed and continue to be harmed due to lack of courage, honesty, and principles. The lieutenant governor position has no judicial power. They are not to decide what takes place when any uncertainty or question of what to do; however, it is clearly in the law that the lieutenant governor was to receive those nominee names and place them onto the general election ballot.
Spencer Cox and Deidre Henderson lost the nominee and place on the ballot as Republican Party nominee through the indirect primary election, the party convention. The only right afforded to them, is the right to do a write-in candidate. Deidre Henderson, who is over her own election, is disregarding the law and this blatant disregard for the law is unacceptable.
Utah has become lawless. The spineless individuals who have stated that would represent us by serving on the Utah Republican Party as State Officers and State Central Committee Members are failing us. Wherefore, claims will be filed under 42 U.S. Code 1983 - Civil action for deprivation of rights, unless the wrongs are corrected. When the law is so egregiously ignored and twisted, leaving people misinformed about what it truly says, and when those in power continue to turn a blind eye, I am left with no choice but to hold them accountable to the commitments they made when they chose to represent me in the party. Your rights cannot taken without just compensation.
